Definitions** In these General Terms and Conditions, the following terms shall have the following meanings: * **"Platform"** means the online platform operated by Oprocon that facilitates the purchase and sale of new production machinery. * **"User"** means any person or entity that uses the Platform. * **"Buyer"** means a User that purchases new production machinery from a Seller through the Platform. * **"Seller"** means a User that sells new production machinery through the Platform. * **"Technical Advisor"** means a third-party service provider that provides technical advice and support to Buyers and Sellers through the Platform. **2. Scope of Application** These General Terms and Conditions apply to all use of the Platform, including the browsing of the Platform, the creation of an account, the purchase of new production machinery, and the use of the Technical Advisor. **3. Registration** To use the Platform, Users must create an account. To create an account, Users must provide their name, email address, and password. **4. Purchase of New Production Machinery** Buyers can purchase new production machinery from Sellers through the Platform. Buyers are responsible for reviewing the specifications and pricing of the new production machinery before making a purchase. Once a Buyer has made a purchase, the Seller will be responsible for shipping the new production machinery to the Buyer. The Buyer is responsible for paying for the shipping costs. **5. Technical Advisor** The Platform offers access to a Technical Advisor that can provide technical advice and support to Buyers and Sellers. The Technical Advisor is a third-party service provider and is not affiliated with [Company Name]. **6. Fees** Oprocon charges a fee for the use of the Platform. The fees are based on the type of account and the features that are used. **7. Refunds** Buyers are entitled to a refund if the site does not meet the specifications that were advertised. **8. Limitation of Liability** Oprocon is not liable for any damages that are caused by the use of the Platform. This includes, but is not limited to, damages caused by the following: * **Errors or omissions in the information provided on the Platform** * **Failure of the Platform to operate as expected** * **Damage to the Buyer's property or the Buyer's business** **9. Governing Law** These General Terms and Conditions shall be governed by and construed in accordance with the laws of Germany. **10. Dispute Resolution** Any disputes arising out of or in connection with these General Terms and Conditions shall be resolved by binding arbitration in accordance with the rules of the International Chamber of Commerce. The arbitration shall be held in Hannover, Niedersachsen, Germany. **11.
